A backyard shed in Qualicum Beach under 10.0 m² (108 square feet) and 3.0 m (9.8 feet) high needs no building permit if it complies with zoning, according to the Town’s Development and Construction Guide. Zoning Bylaw No. 900, 2024 still governs every shed: in the common R1 and R2 zones, accessory buildings can total 75 m² (807 square feet) and can’t be taller than 4.5 m (14.8 feet). The rear setback for larger sheds, any front-yard rule and the distance from the house aren’t stated in the bylaw, so those points are flagged below instead of guessed.
Quick answer: do you need a permit for a shed in Qualicum Beach?
- No building permit is needed for a building under 10.0 m² in area and 3.0 m high or lower that complies with zoning. A new accessory building greater than 10 m² needs one.
- Plumbing in the shed needs a permit. Accessory buildings that don’t need a building permit don’t need a development permit either.
- Zoning rules apply to every shed, permit or not: 4.5 m height, 75 m² total, and the setbacks in the table below.
| Bylaws | Zoning Bylaw No. 900, 2024 (general regulations s.3.3.1; R1 s.3.4.111; R2 s.3.4.112). Building Bylaw No. 903, 2024 (s.3.3(a)). |
|---|---|
| Permit threshold | Town Development and Construction Guide, sheet 7 (updated 26 August 2025): no building permit for buildings less than 10.0 m² in area and 3.0 m or lower that comply with zoning. The Town’s Building Applications FAQ says a permit is required for a new accessory building greater than 10 m². Bylaw 903 s.3.3(a) defers to Division A Part 1 of the BC Building Code. |
| How area is measured | The Guide says “in area” without a method. For zoning, “floor area” is the gross horizontal area of each floor, measured from the inside of the walls (s.2.1). |
| Conditions that remove an exemption | Height over 3.0 m, or not complying with zoning. Plumbing in the shed needs a permit. A shed can’t be used as a dwelling, because an accessory building excludes residential use (s.2.1). |
| Development permit | Accessory buildings that don’t need a building permit don’t need a development permit. |
| Max total accessory area | 75 m² (807 square feet) combined floor area (R1 s.3.4.111; R2 s.3.4.112). Parcel coverage for all buildings is 55%. |
| Max height | 4.5 m (14.8 feet) for an accessory building in R1 and R2. No separate flat-roof figure. Roofs under a 4 in 12 pitch count as flat (s.2.1). |
| Rear setback | 0 m only if 10 m² or less and 3 m or less high. Larger sheds: not confirmed (no accessory figure in the table). |
| Interior side setback | 0 m only if 10 m² or less and 3 m or less high. Otherwise 1.5 m (4.9 feet). Eaves can project up to 1.0 m into a setback (R1 note b). |
| Exterior (corner) side setback | 4.0 m (13.1 feet) for accessory buildings. A 6.0 m sight triangle must stay clear on corner lots (s.3.3.6). |
| Front yard | Not confirmed. R1 and R2 list front setbacks only for dwellings and garages. |
| Separation from house | Not confirmed. No figure found. |
| Zones covered | R1 and R2 (identical accessory figures). RR1 and R5 differ; R5 caps accessory buildings at 10 m² excluding garages (s.3.4.115). |
| Building permit fee | If a permit is needed (Miscellaneous Rates Bylaw No. 638, Schedule E): $75 for the first $10,000 of value plus $10 per $1,000 above that. Plan processing is $40 under $10,000 or $100 for $10,000 to $50,000. A $1,000 security is refundable. Example: a $10,000 shed costs $100 plus $75, so $175, plus the refundable security. |
What the BC Building Code says
BCBC 2024 Division A 1.1.1.1(2)(e) says the Code doesn’t apply to accessory buildings less than 10 m² in building area that don’t create a hazard, and “hazard” isn’t defined, so the local building official decides. The Town’s own Development and Construction Guide gives the 10.0 m² and 3.0 m wording used for the permit tiles on this page, while Building Bylaw 903 only defers to the Code, and every height, area and setback figure comes from the Town’s Zoning Bylaw No. 900 and its fee figures from the Town’s Miscellaneous Rates Bylaw.
Rules that apply even without a building permit
- Zoning: height, total area, coverage and setbacks apply to every shed, whether or not a permit is needed.
- Electrical: wiring a shed is regulated by Technical Safety BC, not the Town. See Technical Safety BC.
- Use as an office or bedroom: an accessory building can’t be used as a dwelling, and sleeping or working space can trigger permit and Building Code rules.
- Easements and rights-of-way: check the land title for utility easements before placing a shed. Watercourse setbacks of 15 m or more can also apply (s.3.3.7).
What isn’t confirmed
- The rear setback for sheds over 10 m² in R1 and R2.
- Whether sheds are allowed in the front yard.
- Any required distance between a shed and the house.
- The Town has no shed-specific handout, so these rules come from its general guide, FAQ and bylaws.
